Product recalls are often followed by class action litigation. These lawsuits don’t allege physical injury, rather they claim an item marketed as safe is not safe, and because of the false marketing claim the plaintiff (and all consumers) overpaid for the recalled item. 

 

At this presentation, that expands upon a panel discussion at the JPMA Summit, Boaz and Jeremy will explain what recalls are most attractive to plaintiffs’ lawyers, strategies to reduce the risk of being targeted by the plaintiffs’ bar, and how to defend against class action lawsuits. 


Topics will include navigating regulatory reporting requirements, creating a Corrective Action Plan, and consideration of what remedies may not provide consumers with complete relief. Attendees will receive practical insights and real-world examples of how to respond swiftly, transparently, and responsibly when faced with product safety challenges and litigation.

 

Speaker Bios:

 

Jeremy Richardson is a Partner in the Litigation Practice and Intellectual Property Practice of Smith, Gambrell & Russell, LLP. Through SGR and prior firms Jeremy has been an associate member of JPMA for more than a decade.


Jeremy works primarily with consumer product manufacturers, and particularly the juvenile products industry. He practices in New York State courts and Federal courts, and in arbitration. Recently Jeremy’s litigation practice has focused on defending putative class action matters, and particularly post-CPSC-approved voluntary recall cases.


In addition to his affiliation with the Baby Safety Alliance, Jeremy is a member of Toy Association and ASTM International. Jeremy has been a guest lecturer at Parsons School of Design and Fordham Law School on legal and regulatory issues in the fashion and consumer products industries. He earned his B.A. from Washington University in St. Louis and holds a J.D. from Rutgers University School of Law.

 

Boaz Green is a seasoned consumer product lawyer. He has extensive experience advising and representing a wide range of companies on product safety compliance, policy, and enforcement. Boaz provides practical advice, tailored to a company’s business and culture, informed by a deep understanding of consumer product safety laws and regulations, and the internal workings of CPSC.

 

Boaz has worked with a diverse range of companies, ranging from leading retailers, private labelers, and manufacturers, to innovative startups, platform sellers, licensees, and franchisers. He has experience dealing with the full range of products under the Consumer Product Safety Commission’s (CPSC) jurisdiction. In addition to his product safety work, Boaz regularly advises clients on other regulatory matters such as U.S. and international labeling requirements, environmental marketing claims, warranties, right-to-repair laws, and extended producer responsibility (EPR).
