SPSP would like to kick off its 2022 series of webinars with a timely discussion of current and future developments at the CPSC. The change in administrations and recent activities last year indicate that the CPSC may be more active in 2022, especially in enforcement. To help us learn about these developments, we have invited three CPSC veterans to give us their insights and predictions. Ken Ross, SPSP webinar manager, will quiz Mike Gentine, Boaz Green and Michelle Gillice on the following subjects: New commissioners Enforcement activities for civil and criminal matters Trends in reporting Trends in recalls and corrective actions New legislation and rulemaking
Our speakers’ background information is below: Mike Gentine, currently counsel at Keller & Heckman, has served two CPSC commissioners, most recently as Senior Counsel to Commissioner Joseph P. Mohorovic. Both in-house and in private practice, he has represented manufacturers and retailers across CPSC’s broad jurisdiction, both before the agency and in policy discussions with Congress. Mike is a frequent speaker at product safety and product liability conferences, including ICPHSO and the Defense Research Institute’s (DRI) Product Liability Seminar. He has been published and cited in a variety of publications on CPSC matters, including the Washington Post, NBC Nightly News, and DRI’s “For the Defense” and “In-House Defense Quarterly” magazines, and has testified before Congress. Boaz Green, currently Of Counsel at Neal Cohen Law, is former Chief Counsel to CPSC Commissioner Marietta Robinson. Boaz provides practical advice tailored to a company’s business and culture and informed by a deep understanding of consumer product safety laws and regulations and the internal workings of the CPSC. He has extensive experience advising and representing a wide range of companies on product safety compliance, policy, and enforcement. He also advises companies on other consumer product regulatory requirements, such as labeling, advertising, and marketing requirements under federal and state laws. Michelle Gillice, currently Partner with Arnold & Porter, has extensive experience as a product safety lawyer, both in private practice and for more than nine years as a compliance attorney at the CPSC. Michelle helps companies assess their compliance with CPSC regulations, analyze potential reporting obligations, avoid unnecessary recalls, develop effective corrective action plans in the U.S. and as part of coordinated global corrective actions, and defend penalty investigations. Michelle works with manufacturers, importers, distributors, and retailers to develop effective compliance policies and has extensive experience in matters involving industry voluntary standards, testing and certification, flammable fabrics, child-resistant packaging, and labeling requirements under the Federal Hazardous Substances Act. While at CPSC, Michelle was the recipient of the Distinguished Service Award for securing numerous recalls of hazardous drop-side cribs and the Achievement of Commission Excellence Award for leading an interdisciplinary team on all investigations, compliance activities and safety education and outreach related to infant sleep products.
